Chido Toys — Terms and Conditions, Shipping, Returns, and Privacy (Mexico)

1) Merchant Identity

2) Site Use and Acceptance of Terms

By accessing www.chidotoys.com (the "Site") or purchasing from our physical/online stores (the "Store"), you accept these Terms and Conditions (the "T&Cs"). If you do not agree, please do not use the Site/services. We may update them; the date above indicates the current version.

  • Capacity: The Site is intended for individuals 18 years and older; if you are acting on behalf of a legal entity, you declare that you have the authority to bind it.
  • Electronic Communications: You agree to receive notifications by email and on the Site.
  • Limited Use License: Personal and lawful use; resale, scraping, meta-tags, or commercial exploitation without written authorization is prohibited.

3) Product Information, Pricing, and Availability

  • Illustrative Images: Minor variations in color, packaging, rims/tires, or finishes inherent to the production process may occur.
  • Obvious Errors: In the event of typographical errors or price/stock errors, we may cancel the order in whole or in part and refund the amount paid.
  • Prices: Prices may change without prior notice until payment is completed.

4) Registration and Verification

To purchase, you must provide accurate and verifiable data. We may request anti-fraud verifications (e.g., INE, proof of address). You are responsible for the use of your email and for immediately reporting unauthorized access.

5) Purchase Process and Payment Methods

  2. Confirm shipping and billing information
  3. Choose payment method
  4. Receive email confirmation

Accepted Payments: credit or debit cards, SPEI/transfer, payment platforms (e.g., Mercado Pago, aplazo, and kueskipay), bank counter, Oxxo, and in-store payment where applicable.

Deposit/Transfer: If we do not receive payment within 24 business hours of your order, we may cancel it and will notify you by email/WhatsApp; failure to provide this data does not prevent order cancellation.

CFDI 4.0 Invoicing: Request it within 72 hours by sending RFC, business name, tax postal code, and CFDI use to info@chidotoys.com. We do not re-invoice outside the deadline or correct erroneous data provided by the customer.

6) Pre-orders and Limited Edition Items

  • Arrival dates are estimated and subject to supplier, customs, and logistics. We may split shipments.
  • If the supplier cuts quotas or cancels, we offer a full refund or alternatives.
  • Down payments/deposits: Cancellation before arrival: full refund unless there is already a specific import/reservation; in that case, we may retain 5–10% for incurred costs.
  • CHASE/rare variants: Only guaranteed when expressly indicated in the listing.
Note: This clause supersedes previous texts that prevented refunds for pre-order delays.

7) Customized or Special Order Products

For custom dioramas, on-demand prints, embroidery/DTF, or other made-to-order items, there are no cancellations or returns except for manufacturing defects. If we have already imported or ordered a part at your request, reasonable charges for incurred costs apply.

8) Shipping

  • Coverage: Throughout the Republic via FedEx/Estafeta/DHL (carrier chosen by Chido Toys unless expressly selected at checkout).
  • Preparation: 12–48 business hours after payment is credited (may be extended during peak seasons).
  • Estimated Transit: 1–5 business days in urban areas; extended areas may require more time.
  • Rates: Visible at checkout. Free shipping from $2,000 MXN (not cumulative unless otherwise stated).
  • Address and Redelivery: If the label is returned due to incorrect data or absence, we will reschedule with a new payment for the freight(s) or refund less the cost of the shipment(s).

Receipt and Damage: If you notice damage to the packaging or if it is open, ask the courier to note a reservation and take photos of the packaging and contents. Report to info@chidotoys.com within 24 hours. Photos speed up claims, but their omission does not in itself invalidate your right to warranty.

9) Exchanges, Returns, and Cancellations

  • Valid reasons: i) incorrect item shipped; ii) manufacturing defect; iii) transport damage reported within the first 24 hours of receipt with evidence.
  • Timeframe: Online purchases (delivery): 5 calendar days from delivery. In-store purchases or in-store pickup: 2 calendar days from the date of purchase or pickup. Request at info@chidotoys.com with order number, reason, and evidence (photos/video).
  • Item condition: New, unused, with all accessories and complete packaging.

Exclusions

  • No exchanges or returns for change of mind ("I no longer like it"), color/size/design preference, or incompatibility with personal taste.
  • Customized or special order items, mystery boxes, and opened sealed items (unless manufacturing defect).
  • Pre-orders already fulfilled or with specific import/reservation (see §6), unless defect or incorrect item shipped.

Costs

  • Proven incorrect item shipped/manufacturing defect → Chido Toys covers return shipping and offers exchange or full refund.
  • Exceptional cases by courtesy (if authorized outside policy): shipping at customer's expense.

Cancellations

  • After shipment: Valid only if one of the valid reasons applies (defect, incorrect item shipped, or transport damage reported within 24 hours); in other cases, cancellation does not apply.
  • Pre-orders and customized items: see §6 and §7.
Defect vs. collection variation: paint/assembly tolerances or minor packaging changes are not always defects. We consider a defect when the product does not function, has breakage, or a significant missing part.

10) Warranties

We offer 30 calendar days against manufacturing defects from delivery, without prejudice to manufacturer warranties. It does not cover wear and tear from use, mishandling, modifications, or damage from inadequate electrical installations (e.g., LED modules). To claim it: write to info@chidotoys.com with evidence and order number.

11) Reviews, Content, and Moderation

By posting reviews/comments, you confirm that you have the right to do so and grant us a non-exclusive license to display them. We may moderate content that violates these T&Cs (abusive, fraudulent, infringing on IP, etc.).

12) Intellectual Property and Links

Trademarks, logos, texts, photos, videos, and designs on the Site belong to Chido Toys or their owners and may not be used without authorization. The presence of links to third-party sites does not imply endorsement.

13) Technical Interruptions

Access may be interrupted due to maintenance, internet failures, or other events. We will endeavor to restore service promptly. We are not responsible for indirect damages arising from failures beyond our control.

14) Applicable Law and Dispute Resolution

This contract is governed by the federal laws of the United Mexican States and, supplementarily, by those of the State of Mexico. For conciliation, you may contact PROFECO / Concilianet. Jurisdiction of competent courts in Toluca, State of Mexico.

15) Privacy Notice (summary) — see full text

Data Collected: identification/contact (name, email, phone, address, RFC), transactional (tokenized payments, history, waybills), browsing (cookies), and video surveillance in-store where applicable.

Primary Purposes: process orders, payments, shipments, warranties, and invoicing; security and fraud prevention. Secondary Purposes (optional): promotions, newsletters, surveys, and personalized advertising. You can opt out of receiving them by writing to info@chidotoys.com or using the unsubscribe link.

ARCO Rights and Revocation: Request at info@chidotoys.com; we respond within 20 days and, if applicable, implement within an additional 15 days.

Transfers/Processors: payment providers, courier services, hosting, email, and support under processing agreements; we will only transfer when legally required or with your consent.

Cookies: You can manage them in your browser; some functions may be affected.

16) Miscellaneous

  • Assignment: We may assign rights/obligations arising from this contract without affecting your consumer rights.
  • Modifications: We will publish changes with an update date.
  • Severability: If any clause is invalid, the rest remains in force.

17) Operational Annexes (optional)

  • Layaway policy for in-store purchases.
  • Protective packaging policy and box rating (for "mint" collectors).
  • Limited drops/pre-sales policy (anti-bot, limit per customer).
  • Exhibitions/AR policy (LED modules and voltage warnings).
  • Seasonal policy (Hot Sale, Christmas, Children's Day, etc.).
